Tharahni Kalaiselvan / 18/11/2019

Malaysia car accidents has increased since 2012. It is a frightening occurrence to hit a pedestrian while driving a car, but it is not unusual in Malaysia.

It’s a frightening occurrence to hit a pedestrian while driving a car, but it is not unusual in Malaysia. Hitting a pedestrian at a speed of more than 30 miles an hour leads to more serious injuries and deaths. Nevertheless, in a collision where the car travels just 10 miles per hour, a driver can seriously injure a pedestrian. As a driver, knowing what to do with a pedestrian right after an accident is crucial. You can reduce the liability by staying calm and talking to the right parties. Therefore, Malaysian drivers must learn the basic rules of fault, how to claim for injuries and losses and, most importantly, how to prevent these collisions.

What to do after the accident?

Immediately after the accident most drivers who hit pedestrians are extremely upset. However, it is important to calm down and breathe deeply as focus on a few things. First step you need to do is take the injured pedestrian to a safe place. Do not attempt to provide any medical treatment besides what you need in an emergency, such as CPR. Next, seek medical and legal attention. Then notify the police, medical providers and both the driver and the pedestrian’s insurers. When your insurance agent and police arrive, give them truthful statements about how the accident happened.

Exchange contact details, but not much.

Collect the records that are necessary. Exchange your address, phone number, and insurance information with them if the pedestrian is incapacitate. Do not speak to the pedestrian and their friends or family members extensively. Sincerely apologizing, or making statements like “I feel so guilty,” could expose you to a lawsuit for personal injury, so be careful what you are saying. Furthermore, you should also avoid talking explicitly to the insurance company or lawyer for the pedestrian. It is essential that your  insurer interacts with the lawyer of the pedestrian, the motor insurance company or the pedestrian themselves.

Police reports and findings of the insurance companies.

To determine who was at fault, the police will take statements from the driver, pedestrian, and witness if necessary. They can make on the spot a concrete finding or perform a detailed investigation later. The accident police report will show which party the law enforcement officer has considered to be at fault. However motor insurance companies may deny this finding. Usually, insurance companies send an adjuster to the accident scene to assess the damage to people or properties shortly after the accident occurred. If you think the insurance company will wrongly give you a higher percentage of fault consider hiring a personal injury lawyer to claim you have a lower percentage of fault.
